The High-Inherited Wealth In Minangkabau: Perspective Of Islamic Law And Development Solutions By Mahmud Yunus
Status and position of the high-inherited wealth in Minangkabau cause differences in views and opinions of Minangkabau’s scholars. Mahmud Yunus as one scholar who played significant roles in the development and reform of Islam in Indonesia also shared in giving his views and opinions. The objectives of this study was to determine and to describe the views of Minangkabau’s scholars toward the status and position of the high-inherited wealth in Minangkabau as well as to explain and analyze Mahmud Yunus views of the status and position of the high-inherited wealth in Minangkabau and development solutions. This study was a qualitative study. The main data obtained from the fiqh works of Mahmud Yunus, while supporting data were obtained from relevant books of classic and contemporary jurisprudence and other resources that are appropriate, and then was analyzed with content analysis techniques (content analysis) through descriptive, analytical and comparative methodology. The findings showed that Minangkabau’s scholar, including Mahmud Yunus, generally viewed that the high-inherited wealth in Minangkabau as well as property musabalah/waqf in Islam. The high-inherited wealth in Minangkabau was in accordance with the provisions of Minangkabau matrilineal and was not inherited in terms of Islamic faraid. Similarly, some of the results of the meeting between traditional leaders and scholars in Minangkabau shared the same views. In contrast, the low-inherited wealth (matrimonial) can be inherited according to Islamic faraid. Mahmud Yunus also shared a view and development solution that is necessarily always 'dilambuk' (added) from the low-inherited wealth (matrimonial) by way of testament. This is caused by members of the tribe/ethnic Minangkabau quantitatively been growing and increasing over the time.
