Sharenting: Implikasinya dari Perspektif Perundangan Malaysia

Abstract

Perkongsian maklumat secara tidak terkawal boleh menimbulkan beberapa masalah perundangan. Tren mutakhir yang dikenali sebagai sharenting menunjukkan kesungguhan ibu bapa untuk berkongsi maklumat berkaitan anakanak mereka secara bebas tanpa batasan melalui internet. Perkongsian maklumat secara berlebihan di media sosial perlu dilihat dari aspek keselamatan maklumat peribadi, kerahsiaan dan privasi. Artikel ini bertujuan melihat isu sharenting secara lebih holistik dengan mengkaji keperluan undangundang untuk mengawalnya daripada berleluasa. Kajian ini menggunakan kaedah kualitatif secara sosioperundangan dengan mengkaji kesan sharenting kepada keadaan semasa dan melihat tahap kawalan undang-undang yang sedia ada. Hasil kajian mendapati bahawa wujud keperluan untuk melihat isu ini secara lebih serius dengan membuat penambahbaikan terhadap undang-undang sedia ada supaya perlindungan yang lebih komprehesif boleh ditawarkan kepada anak-anak.

Uncontrollable information-sharing may cause some legal issues. The recent trend is that parents are eager to share information regarding their children freely and without restrictions via the Internet. This is known as ‘sharenting’. The sharing of such information must be viewed in terms of the security of personal information, confidentiality and privacy. The aim of this article is to take a holistic look at the issue of sharenting by examining the necessity of legal controls. This research is a qualitative sociolegal research that studies the implication of sharenting in the current situation, and the adequacy of existing legal protection. The research reveals that there is a need for this issue to be looked at more seriously and that improvements to existing laws are necessary to provide more comprehensive protection to children.
